This Privacy Policy describes how AHP Mechanical Services, LLC doing business as Alabama Home Performance ("Company," "we," "us," or "our") collects, uses, discloses, and protects information when you visit or use AlabamaHomePerformance.com (the "Site") and any related services we provide (collectively, the "Services").

Not legal advice: This Privacy Policy is provided for general informational purposes. It is not legal advice, and you should consult an attorney to ensure compliance with laws that apply to your business, customers, and operations.

In this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. In some jurisdictions, this may be referred to as “personal data.”

1. Scope

This Privacy Policy applies to information we collect through the Services and through communications with you (for example, email support). It does not apply to third-party websites, products, or services that may be linked from our Services. Your use of the Services constitutes your acknowledgment of this Privacy Policy.

We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party website or service you visit.

2. Information We Collect

·         Information you provide: such as your name, email address, phone number, billing/shipping address, account credentials, messages you send to us, and any other information you choose to provide.

·         Payment information: if you make purchases, our payment processor(s) process your payment card details. We generally do not store full payment card numbers on our systems. We may retain limited payment-related information, such as billing contact details and transaction identifiers, for receipts, recordkeeping, and customer support.

·         Automatically collected information: such as your IP address, device identifiers, browser type, operating system, referring/exit pages, pages viewed, links clicked, and the dates/times of your visits.

·         Cookies and similar technologies: such as cookies, pixels, local storage, and similar technologies used to remember preferences and understand usage. See Section 3.

·         Information from third parties: such as analytics providers, advertising partners (if any), social media platforms (if you interact with our pages), or service providers that help us operate the Services.

3. Cookies, Analytics, and Similar Technologies

We use cookies and similar technologies to operate the Services, remember your preferences, and understand how the Services are used. You can control cookies through your browser settings. Where required by law, we will also provide a cookie notice and choices for non-essential cookies. Note that disabling cookies may impact functionality.

We may use analytics tools (for example, Google Analytics or similar services) to help us measure traffic and usage trends. These providers may collect information about your device and browsing activity over time and across different websites, subject to their own privacy policies and settings.

4. How We Use Information

We use information we collect to:

·         Provide, operate, maintain, and improve the Services;

·         Create and manage accounts (if applicable);

·         Process transactions and send related information such as confirmations and invoices;

·         Communicate with you, including responding to requests and sending service-related messages;

·         Personalize content and remember preferences;

·         Monitor, prevent, and address security issues, fraud, abuse, and violations of our terms;

·         Comply with legal obligations and enforce our agreements; and

·         For any other purpose described to you at the time of collection or with your consent.

5. Legal Bases for Processing (EEA/UK)

If you are located in the European Economic Area (EEA) or the United Kingdom, we process personal data only where we have a lawful basis, including: (a) to perform a contract with you; (b) to comply with a legal obligation; (c) where we have legitimate interests that are not overridden by your rights; and/or (d) where you have given consent (which you may withdraw at any time).

6. How We Share Information

We may share information as follows:

·         Service providers: with vendors who help us operate the Services (e.g., hosting, analytics, customer support, email delivery, payment processing). They may access information only as needed to perform services for us and are expected to protect it.

·         Business transfers: in connection with an actual or contemplated merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or transition of service.

·         Legal and safety: to comply with law, respond to lawful requests, protect our rights and property, enforce our terms, or protect the safety of users or others.

·         With your direction: when you ask us to share or you otherwise consent.

7. Data Retention

We retain information for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, resolve disputes, establish legal defenses, conduct audits, and comply with applicable laws. Retention periods may vary depending on the type of information and why it is collected.

8. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information. However, no security measure is perfect and we cannot guarantee absolute security.

9. Children’s Privacy

The Services are not directed to children under 13 and we do not knowingly collect Personal Information from children. If you believe a child has provided Personal Information to us, please contact us and we will take steps to delete such information.

10. International Data Transfers

If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other countries where we or our service providers operate. These countries may have data protection laws different from those in your jurisdiction.

11. Your Rights and Choices

Depending on your location and applicable law, you may have certain rights regarding your personal information, including the right to request access, correction, deletion, or portability; to object to or restrict certain processing; and to withdraw consent (where processing is based on consent). You may also have the right to appeal a decision we make about your request.

To submit a request, contact us at stephen@alabamahomeperformance.com. We may need to verify your identity before fulfilling certain requests.

If you are submitting a request as an authorized agent (where permitted by law), we may request proof of your authorization and may also require the consumer to verify their identity directly with us.

Marketing communications: If we send marketing emails, you can opt out by using the unsubscribe link in those messages. You may still receive non-promotional, service-related communications.

12. Do Not Track

Some browsers offer a “Do Not Track” (DNT) signal. Because there is no consistent industry standard for DNT, our Services do not respond to DNT signals.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last updated” date above indicates when this Privacy Policy was last revised. If we make material changes, we may provide additional notice as required by law.
